WickTap Terms and Conditions

Last updated: 28 October 2026

Key points (read these first). This summary helps you find the most important terms. It does not replace them, and the full Terms below govern.

  1. WickTap is a charting tool for TradingView. It does not place trades, give buy or sell signals, make recommendations or provide investment advice. We are not licensed by the Securities Commission Malaysia.
  2. Futures trading carries a high risk of loss. Every trading decision, and every loss, is yours alone. Read the Risk Disclosure.
  3. Early Access is free. Registering does not guarantee access, a price, a package or a launch date.
  4. Paid access will be delivered through TradingView, a third party we do not control. If you buy through the TradingView Marketplace, TradingView's terms govern payment, billing and refunds.
  5. Your licence is personal to one TradingView username. Copying, reverse engineering, redistribution, screen-sharing and account or username sharing are prohibited, and breach may lead to termination without refund.
  6. Digital access is not refundable once granted, except where the law requires otherwise. See the Refund Policy.
  7. Our liability is limited as far as the law allows. Nothing in these Terms removes any right you have as a consumer that the law does not allow us to remove.

1. About these Terms

1.1 These Terms and Conditions ("Terms") govern your access to and use of the website at https://wicktap.com and its pages and subdomains (the "Website"), the WickTap Early Access waitlist, and any purchase, licence or use of the WickTap indicator.

1.2 The Website and the WickTap indicator are operated by WickTap ("we", "us", "our"). You can contact us at hi@wicktap.com.

1.3 By accessing the Website, submitting the Early Access form, purchasing access to WickTap, or using WickTap, you agree to be bound by these Terms. If you do not agree, you must not use the Website or WickTap.

1.4 These Terms form a contract concluded by electronic means. Under the Electronic Commerce Act 2006, a contract formed by electronic message is not denied legal effect, validity or enforceability solely because it is in electronic form. You agree that clicking a button, ticking a box or submitting a form on the Website or on TradingView is a valid way of entering into this contract.

1.5 The following documents form part of these Terms: the WickTap Privacy Notice (English and Bahasa Melayu versions), the WickTap Risk Disclosure and Disclaimer ("Risk Disclosure"), the WickTap Refund and Cancellation Policy ("Refund Policy"), and any Documentation or point-of-sale terms we show you when you buy access. If they conflict: (a) the Privacy Notice governs the processing of personal data; (b) the Refund Policy governs refunds and cancellations; and (c) in all other matters, these Terms prevail.

2. Definitions and interpretation

2.1 In these Terms:

  • "Consumer" has the meaning given in section 3 of the Consumer Protection Act 1999 ("CPA").
  • "Content" means all text, graphics, videos, images, charts, data, code, layouts and other material on the Website, including the Replays and the Illustrative Reviews.
  • "Direct Purchase" means a purchase of access to WickTap made directly from us and not through the Marketplace.
  • "Documentation" means the user guides, feature descriptions, settings explanations and other written materials we publish for WickTap, including the description of its repaint and real-time behaviour, to be published at launch.
  • "Early Access" means the free WickTap waitlist and any pre-release access we decide to offer to registered persons.
  • "Illustrative Reviews" means the review cards shown on the Website that are labelled as illustrative examples.
  • "Mandatory Law" means any law that cannot be excluded, restricted or modified by agreement, including, to the extent they apply, the CPA and the Personal Data Protection Act 2010 ("PDPA").
  • "Marketplace" means the TradingView Marketplace, or any successor programme through which TradingView sells or administers paid access to scripts.
  • "Marketplace Purchase" means a purchase of access to WickTap made through the Marketplace.
  • "Replays" means the replay videos of selected past FCPO market sessions shown on the Website.
  • "Subscription" means a paid right to access WickTap for a period, however purchased.
  • "TradingView" means the operator of the TradingView platform at tradingview.com and its affiliates.
  • "WickTap" or the "Indicator" means the WickTap technical-analysis indicator, in every version, update and configuration, together with its Documentation.

2.2 In these Terms: (a) "including" and similar words mean "including without limitation"; (b) headings are for convenience only; (c) the singular includes the plural and vice versa; (d) a reference to a law includes that law as amended or re-enacted and any subsidiary legislation made under it; and (e) "in writing" includes email.

3. Eligibility

3.1 You must be at least 18 years old and have full legal capacity to enter into a binding contract.

3.2 You are responsible for ensuring that your access to the Website and your use of WickTap are lawful in the place where you are located. We make no representation that WickTap is appropriate or lawful for use outside Malaysia.

3.3 If you accept these Terms on behalf of a company or other organisation, you confirm that you have authority to bind it, and "you" includes that organisation.

3.4 Business use. The protections in the CPA apply only to a Consumer. If you acquire or use WickTap for the purposes of a business (for example, as a trading company, proprietary trading firm, fund manager, signal provider or adviser), you may not be a Consumer, and in that case every provision of these Terms that applies "to the fullest extent permitted by law" applies to you in full.

4. What WickTap is, and what it is not

4.1 WickTap is a Smart Money Concept ("SMC") technical-analysis indicator that runs on TradingView. It marks market structure (CHoCH and BOS), IDM, Order Blocks (Decisional and Extreme), SCOB, EQH and EQL, Imbalance, and Premium and Discount zones. Its primary focus is FCPO (Crude Palm Oil Futures traded on Bursa Malaysia Derivatives). It may also be used on other futures markets, including Crude Oil, FKLI and Nasdaq, S&P 500 and Dow index futures.

4.2 WickTap does not: (a) place, execute, modify or manage any trade or order; (b) connect to any brokerage or trading account; (c) give buy, sell or hold signals, recommendations or advice; or (d) take into account your objectives, financial situation, experience or needs.

4.3 No investment advice and no licence. We do not hold a Capital Markets Services Licence and are not a registered person under the Capital Markets and Services Act 2007 ("CMSA"). Nothing on the Website, in WickTap, in the Documentation, in our emails, WhatsApp messages or social media, or in any other communication from us is, or is intended to be, investment advice, a recommendation, an offer or solicitation to buy or sell any securities or derivatives, dealing in derivatives, fund management or financial planning. No fiduciary, advisory or client relationship arises between you and us.

4.4 The markings produced by WickTap are algorithmic labels generated by our implementation of SMC concepts, which are themselves interpretive and discretionary. They are not predictions, and other traders, tools or methods may identify the same price action differently.

4.5 The Risk Disclosure forms part of these Terms. You must read it before using WickTap.

4.6 Any stop-loss, take-profit, entry, tick or risk-to-reward ("RR") figure shown on the Website, in the Replays, in the Documentation or in our communications is an educational illustration only. It is not a recommendation to enter, exit or size any trade.

4.7 You alone decide whether, when and how to trade. If you need advice, you should consult a person licensed under the CMSA.

5. Use of the Website

5.1 We grant you a limited, revocable, non-exclusive, non-transferable permission to view the Website and its Content for your personal, non-commercial information.

5.2 We may change, suspend or discontinue any part of the Website at any time. We do not guarantee that the Website will be available, uninterrupted, secure or free of errors.

5.3 You must not: (a) use the Website for any unlawful, fraudulent or harmful purpose; (b) interfere with, disrupt or attempt to gain unauthorised access to the Website, its servers or its security features; (c) scrape, crawl, harvest or copy the Website or its Content by automated means; (d) attempt to bypass any rate limit, security challenge or access control; (e) introduce malware or carry out vulnerability or load testing without our written consent; (f) submit false information, or the personal data of another person, in any form; or (g) frame, mirror or republish the Website or any Content.

5.4 The Website may link to third-party websites. We do not control them and are not responsible for their content, policies or practices.

6. Early Access

6.1 Early Access is free. Registering for it is an expression of interest only and does not create a contract for the supply of WickTap.

6.2 No obligation. At the date of these Terms, the price, packages and launch date of WickTap have not been announced. Registration does not oblige us to launch WickTap, to offer you access, to offer any particular price, package, discount or bonus, or to do anything by any particular date. We decide these matters at our discretion.

6.3 We may limit the number of registrations, prioritise registrations in any order, and decline or remove any registration, including registrations we reasonably believe to be false, duplicated, automated or abusive.

6.4 You must give accurate information and register only yourself. If you submit the form again with the same email address, we may update the details and communication preferences held for that address.

6.5 Any pre-release, beta or preview version of WickTap that we make available is provided for evaluation, may contain errors, may be changed or withdrawn at any time without notice, and may be subject to additional terms that we show you.

6.6 Any non-public information we share with you through Early Access (including pre-release builds, unpublished settings, Documentation drafts and pricing communicated privately) is confidential. You must not disclose it to anyone without our prior written consent, unless it has become public other than through your breach.

6.7 If you give us suggestions, comments or other feedback about WickTap or the Website, you grant us a perpetual, irrevocable, worldwide, royalty-free and transferable licence to use, modify and commercialise it for any purpose, without any obligation to you. This clause does not apply to your personal data, which is governed by the Privacy Notice.

6.8 We will contact you about your registration as described in the Privacy Notice. We will send marketing by email or WhatsApp only in line with the consents you choose on the form, and you may withdraw them at any time.

6.9 You may ask to be removed from the waitlist at any time by contacting us at hi@wicktap.com.

7. Paid access: subscriptions and purchases

7.1 General. When paid access to WickTap becomes available, we will show the price, packages, billing terms and any additional conditions before you pay. These Terms, together with those point-of-sale terms, apply to every purchase.

7.2 TradingView Marketplace rule. TradingView has announced that, from 1 November 2026, access to invite-only scripts may not be sold outside the Marketplace. We will therefore sell access to WickTap only through channels that TradingView's terms permit at the time of sale.

7.3 Marketplace Purchases. If you buy access through the Marketplace:

  • (a) your payment, billing, renewal, cancellation, taxes collected by TradingView, refunds and chargebacks are governed by TradingView's terms and policies, and your payment relationship is with TradingView;
  • (b) we do not receive or control your payment details;
  • (c) TradingView's terms prevail over these Terms on payment, billing, renewal, cancellation and refunds; and
  • (d) these Terms govern, as between you and us, your licence to use WickTap, our intellectual property, your conduct, and our disclaimers and liability, to the extent consistent with TradingView's terms.

7.4 Direct Purchases. We are not obliged to offer Direct Purchases. We will offer them only where they are lawfully permitted, including under TradingView's terms at the time. If we do:

  • (a) the price, package, currency and taxes will be stated before you pay;
  • (b) payment may be made by the methods shown at the point of sale;
  • (c) before you confirm an order, you will be able to review it and correct any input errors, and after confirmation you may contact us at hi@wicktap.com to correct an error in your order details (including your TradingView username);
  • (d) we will acknowledge receipt of your order without undue delay, and a contract for your order is formed when we send you our order confirmation;
  • (e) we may refuse or cancel an order before access is granted, including where the price shown was an obvious error, payment is not cleared, we suspect fraud, or we are unable to grant access. If we cancel, we will refund in full any amount you paid for that order; and
  • (f) renewal terms will be stated at the point of sale. If a Direct Purchase Subscription renews automatically, we will tell you clearly before you pay, and you may cancel future renewals at any time before the next renewal date.

7.5 Dependence on TradingView. In every case, the availability of WickTap and of any Subscription depends on TradingView, which is a third party outside our control (see Section 19).

7.6 Price changes. We may change our prices at any time. A price change does not affect any period you have already paid for. For a recurring Direct Purchase Subscription, we will give you at least fourteen (14) days' notice by email before a new price applies at your next renewal, and you may cancel before that renewal. For Marketplace Purchases, price changes take effect under TradingView's terms.

7.7 Promotions. Discounts, bonuses, launch offers and promotional codes are offered at our discretion, may be withdrawn at any time before purchase, cannot be combined unless we say so, and have no cash value.

8. Delivery of access through TradingView

8.1 To use WickTap you must have, at your own cost: (a) a TradingView account in good standing; (b) a TradingView plan that supports invite-only scripts and the features you wish to use; and (c) any exchange data subscriptions needed to see real-time or delayed market data on TradingView. TradingView plans and exchange data fees are not included in the price of WickTap unless we expressly say so.

8.2 You must give us, or TradingView, your exact TradingView username. We are not responsible for any failure or delay in delivery caused by an incorrect or changed username. Each licence covers one TradingView username only. We may, at our discretion and after verification, move access to a replacement username if your original account is lost or closed.

8.3 Access is delivered when your TradingView username is added to the access list for the WickTap invite-only script ("Access Granted"). For Marketplace Purchases, delivery takes place through TradingView's systems. For Direct Purchases, we will grant access within the period stated at the point of sale after your payment has cleared and we have received your correct username.

8.4 WickTap is delivered as an invite-only script inside TradingView. We do not provide source code, and nothing in these Terms entitles you to receive it.

8.5 TradingView may at any time change Pine Script, its platform features, its plans, its Marketplace rules or its terms, and may hide, restrict, suspend or remove scripts or accounts. We are not responsible for any such action. Where an action of TradingView affects WickTap, we will use reasonable efforts to restore access where that is feasible and permitted.

8.6 If TradingView suspends or closes your TradingView account because of your conduct, you are not entitled to a refund from us.

9. Licence to use WickTap

9.1 Subject to your compliance with these Terms and payment of all applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to use WickTap through TradingView, on charts viewed by you, for your own trading analysis, for the period of your Subscription.

9.2 The licence is personal to one individual using one TradingView username. If you are an organisation, it covers one designated individual unless we agree otherwise in writing.

9.3 WickTap is licensed, not sold. No ownership of any intellectual property passes to you. We reserve all rights not expressly granted.

9.4 The licence ends automatically when your Subscription expires or is terminated, and we may then remove your username from the access list.

9.5 We may, but are not obliged to, provide updates. Updates are applied through TradingView, may change features, settings or appearance, and are governed by these Terms.

10. Intellectual property

10.1 All intellectual property rights in the Website, the Content, WickTap (including its code, algorithms, logic, parameters, default settings, visual design, labelling and presentation), the Documentation, and the WickTap name, logo and brand (whether registered or not) belong to us or our licensors, and are protected by laws including the Copyright Act 1987 and the Trademarks Act 2019.

10.2 General trading concepts, such as market structure, order blocks and liquidity, are not owned by anyone. Our rights are in our own implementation of them: our code, logic, parameters, Documentation, Content, presentation and brand.

10.3 You must not use our name, logo or trade marks, or any confusingly similar mark, without our prior written consent.

10.4 TradingView, FCPO, FKLI, Nasdaq, S&P 500, Dow Jones and other third-party names are the property of their respective owners. We are not affiliated with, endorsed by or sponsored by TradingView, Bursa Malaysia or any exchange or index provider, unless we expressly say so.

10.5 Because a breach of this Section 10 or of Section 11 may cause us harm that damages alone cannot adequately remedy, we may seek an injunction or other equitable relief, in addition to any other remedy available to us.

11. Prohibited conduct

11.1 You must not, and must not allow or help anyone else to:

  • (a) copy, reproduce, modify, translate or create derivative works of WickTap, the Documentation or the Content;
  • (b) reverse engineer, decompile, disassemble, deobfuscate or otherwise attempt to derive the source code, algorithms, logic or parameters of WickTap, including by systematically recording or analysing its outputs for the purpose of reproducing it;
  • (c) create, publish or distribute any indicator, script, strategy or software that copies or substantially replicates the logic, labels or outputs of WickTap;
  • (d) sell, resell, rent, lend, sublicense, transfer, share or otherwise make access to WickTap available to any other person, including through "group buys" or shared subscriptions;
  • (e) share your TradingView account, login details or username, or let any other person use WickTap through your account, or use more TradingView usernames than your licence covers;
  • (f) screen-share, broadcast, live-stream, record, publish, teach or demonstrate WickTap in operation, or explain its settings or internal logic, to any third party, including in paid or free groups, signal channels, courses, webinars or social media live streams, without our prior written consent;
  • (g) forward, relay or republish WickTap's alerts, labels or outputs as signals, or use them to operate any signal, alert, copy-trading or advisory service for others, whether paid or free;
  • (h) circumvent or attempt to circumvent any invite-only restriction, licence control or TradingView security measure;
  • (i) remove or alter any proprietary notice, label or branding;
  • (j) use WickTap or the Content to build or improve a competing product;
  • (k) use WickTap in breach of TradingView's terms or of any law, including by using it to provide investment advice to others without a licence required under the CMSA; or
  • (l) state or suggest that we endorse you, or attribute to WickTap any claim about profits, accuracy or results.

11.2 Permitted screenshots. Despite Section 11.1(f), you may share an occasional static screenshot of a chart showing WickTap for personal, non-commercial purposes, provided that it does not reveal the Indicator's settings, configuration or internal logic, is not used as a trading signal for others, and does not suggest our endorsement. We may withdraw this permission at any time by notice.

11.3 We may monitor compliance with this Section, including by reviewing the access list and publicly available content, in accordance with the Privacy Notice.

11.4 A breach of Section 10 or this Section 11 is a material breach of these Terms. In addition to our rights under Section 16, we may claim damages, an account of profits and injunctive relief.

12. Replays, illustrative reviews and educational content

12.1 Replays. The Website shows replay videos of selected past FCPO sessions. The label "Real FCPO Market Data" means that the price data shown comes from actual past market sessions. It does not mean that the outcomes shown are typical, likely or representative. The sessions were selected by us to illustrate how WickTap's markings appear. They are not a random sample or a complete record. Unless a Replay expressly states otherwise, it does not show trades actually executed by us or by any user.

12.2 Stop-loss and take-profit distances shown in ticks, and RR ratios, are hypothetical figures calculated with the benefit of hindsight and before commissions, exchange and clearing fees, slippage, taxes, data fees and subscription costs. Past performance does not guarantee future results.

12.3 Illustrative Reviews. The review cards on the Website are illustrative examples prepared to show possible ways of using WickTap. They are not actual user testimonials, are not statements made by real users, and are not endorsements by any person. Any names, initials, roles or descriptions in them are illustrative. They do not represent results achieved by anyone, and you must not rely on them.

12.4 Educational content. Content on the Website and in our communications is general in nature, does not take your circumstances into account, may become out of date, and is provided for information and education only.

12.5 You agree that you have not relied on any Replay, Illustrative Review or other Content in deciding to register for Early Access or to buy access to WickTap, other than the description of WickTap's main characteristics in these Terms and at the point of sale.

13. Disclaimers

13.1 As is and as available. To the fullest extent permitted by law, and subject to Section 13.4, the Website, the Content, Early Access and WickTap are provided "as is" and "as available", with all faults.

13.2 No warranties. To the fullest extent permitted by law, and subject to Section 13.4, we make no warranty, representation, condition or guarantee, express or implied, that:

  • (a) WickTap or any Content is accurate, complete, timely, reliable or free of errors;
  • (b) any marking, label or zone will be correct, will hold, or will appear in real time as it later appears on a historical chart;
  • (c) WickTap will be profitable, will reduce losses, or will achieve any trading result;
  • (d) WickTap will be fit for any particular purpose, or compatible with your TradingView plan, device, browser or data subscription;
  • (e) the Website or WickTap will be uninterrupted, secure or free from viruses; or
  • (f) any defect will be corrected.

13.3 Third-party data and services. Market data displayed on TradingView is supplied by TradingView, exchanges and data vendors. It may be delayed, incomplete or inaccurate, and we do not verify it. We give no warranty in respect of TradingView, Cloudflare, any data feed, any broker or any exchange.

13.4 Your statutory rights. Nothing in these Terms excludes, restricts or modifies any right, guarantee or remedy that you have as a Consumer under the CPA (including the implied guarantees for services in Part VI of the CPA, where they apply) or under any other Mandatory Law. Every provision of these Terms is to be read subject to those rights.

13.5 If you are not a Consumer, all terms, conditions and warranties that would otherwise be implied by statute, common law or otherwise are excluded to the fullest extent permitted by law.

14. Limitation of liability

14.1 Excluded losses. To the fullest extent permitted by law, and subject to Section 14.4, we are not liable to you, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for:

  • (a) any trading loss, or any loss arising from a trading decision you make, including a decision made in reliance on WickTap or any Content;
  • (b) any loss of profit, revenue, business, opportunity, goodwill or data;
  • (c) any indirect, consequential, special, incidental or punitive loss or damage;
  • (d) any loss caused by TradingView, Cloudflare, a data vendor, an exchange, a broker, a payment provider or any other third party; or
  • (e) any loss caused by an event described in Section 20.

14.2 Cap. To the fullest extent permitted by law, and subject to Section 14.4, our total aggregate liability for all claims arising out of or in connection with these Terms, the Website, Early Access and WickTap shall not exceed the greater of:

  • (a) the total fees actually paid by you for access to WickTap, whether paid to us directly or through the Marketplace, during the twelve (12) months immediately before the event giving rise to the claim; and
  • (b) one hundred Ringgit Malaysia (RM100).

14.3 Why these limits are reasonable. You acknowledge that WickTap is a general analysis tool, that trading results depend on your own decisions and on market conditions outside our control, that Early Access is free, and that our prices reflect the allocation of risk in this Section 14.

14.4 What we do not limit. Nothing in these Terms excludes or limits our liability for:

  • (a) fraud or fraudulent misrepresentation;
  • (b) death or personal injury caused by our negligence;
  • (c) where you are a Consumer, negligence, or breach of any guarantee under the CPA, to the extent that the law does not allow that liability to be excluded or restricted; or
  • (d) any other liability that cannot be excluded or limited by law.

15. Indemnity

15.1 To the fullest extent permitted by law, you agree to indemnify us and our officers, employees, agents and licensors ("Indemnified Persons") against all losses, liabilities, damages, fines, costs and expenses (including reasonable legal fees) arising out of or in connection with:

  • (a) your breach of these Terms, including Sections 10 and 11;
  • (b) your infringement or misappropriation of our intellectual property or that of any third party;
  • (c) your breach of any law or of TradingView's terms; or
  • (d) any claim by a third party arising from your use of WickTap for, or your provision of any service to, that third party, including any signal, alert or advisory service.

15.2 You are not required to indemnify any Indemnified Person to the extent that the loss was caused by that person's own fraud, negligence or breach of these Terms.

15.3 We will notify you of any claim covered by this Section. You must cooperate with us, and we may take control of the defence of the claim at your reasonable cost.

16. Suspension and termination

16.1 By you. You may stop using WickTap at any time. You may cancel future renewals as described in Section 7, and may ask to be removed from the waitlist under Section 6.9. Cancellation does not entitle you to a refund except as stated in the Refund Policy.

16.2 By us, for cause. We may suspend or terminate your access to WickTap (including by removing your username from the access list), and remove your Early Access registration, immediately and without refund, if:

  • (a) you commit a material breach of these Terms, including any breach of Section 10 or 11;
  • (b) we reasonably suspect fraud, chargeback abuse, account or username sharing, or redistribution;
  • (c) we are required to do so by law, by a court or regulator, or by TradingView;
  • (d) your TradingView account is suspended or closed; or
  • (e) you behave abusively or threateningly towards us, our personnel or other users.

Where a breach can be remedied and is not a breach of Section 10 or 11, we may, but need not, give you an opportunity to remedy it first. If we suspend your access pending an investigation and then find no breach, we will restore your access and, for a Direct Purchase, extend your Subscription by the period of the suspension.

16.3 By us, without cause. We may discontinue WickTap, or any Subscription plan, for any reason. Where practicable, we will give you reasonable advance notice by email. If you have prepaid for a Direct Purchase Subscription period that has not yet ended, we will refund the unused portion on a pro-rata basis. For Marketplace Purchases, any refund is handled under TradingView's terms, and we will cooperate with TradingView's processes where applicable.

16.4 If TradingView prevents supply. If TradingView blocks, removes or prohibits the continued supply of WickTap, or changes its rules so that we can no longer lawfully supply it, our obligation to supply ends. For a Direct Purchase, we will refund the unused portion of any prepaid period to the extent required by law, including section 66 of the Contracts Act 1950. Otherwise we have no liability to you for that event.

16.5 Effect of termination. On expiry or termination, your licence ends and you must stop using WickTap. Sections 10, 11, 12, 13, 14, 15, 18, 22, 23 and 24, and any other provision that by its nature should survive, survive termination. Termination does not affect rights or liabilities that have already accrued.

17. Changes to WickTap, prices and these Terms

17.1 Changes to WickTap. We may update, modify, add or remove features, settings, supported markets or timeframes, rename WickTap, or retire old versions at any time. During a paid Subscription period, we will aim to keep the core functionality described at the time of your purchase. If a change made by us materially and adversely reduces that core functionality during a prepaid Direct Purchase period, you may end your Subscription by notice and receive a pro-rata refund of the unused portion.

17.2 Changes to prices. Section 7.6 applies.

17.3 Changes to these Terms. We may amend these Terms by publishing an updated version on the Website with a new "Last updated" date. For a material change, we will give at least fourteen (14) days' notice by email (where we hold your email address) or by a notice on the Website before it takes effect. A change required by law or by TradingView, or one that does not disadvantage you, may take effect immediately. Changes do not apply to any dispute that arose before they took effect. If you continue to use the Website or WickTap after a change takes effect, you accept the amended Terms. If you do not accept a material change, you must stop using WickTap; for a Direct Purchase, you may end your Subscription before the change takes effect and receive a pro-rata refund of the unused portion of any prepaid period.

18. Refunds and chargebacks

18.1 Refunds and cancellations are governed by the Refund Policy. In summary: access to WickTap is digital, and once Access Granted has occurred it is not refundable, except where Mandatory Law or the Refund Policy requires otherwise. Refunds for Marketplace Purchases are handled by TradingView under its own terms.

18.2 Direct Purchase chargebacks. For a Direct Purchase, you agree to contact us at hi@wicktap.com first about any billing issue, so that we can try to resolve it. If you start a chargeback or payment dispute for a payment that you authorised and for access that was granted, we may:

  • (a) suspend your access while the dispute is resolved, and terminate it if the dispute is resolved in our favour or you have breached these Terms;
  • (b) give the payment provider your order details, access records, correspondence and these Terms as evidence;
  • (c) recover from you, to the extent permitted by law, the disputed amount and the reasonable costs we actually incur because of the dispute (such as bank or processor dispute fees); and
  • (d) refuse future purchases from you.

18.3 Nothing in Section 18.2 limits your right under law, or under your card issuer's or payment provider's rules, to dispute a payment that you did not authorise or that was taken in error.

18.4 For Marketplace Purchases, chargebacks are handled under TradingView's terms. If TradingView reverses your payment, we may remove your access.

19. Third-party services and dependencies

19.1 WickTap and the Website depend on third parties, including TradingView (its platform, Pine Script, invite-only access controls, the Marketplace, user accounts and market data), Cloudflare (website delivery, security and analytics), our hosting provider, email and messaging providers, exchanges and data vendors, and the internet generally.

19.2 Your use of TradingView is governed by your agreement with TradingView. You must comply with TradingView's terms at all times.

19.3 We do not control these third parties and, to the fullest extent permitted by law, are not responsible for their acts, omissions, availability, changes, pricing or policies.

20. Force majeure

20.1 We are not liable for any failure or delay in performing our obligations caused by an event beyond our reasonable control, including natural disaster, flood, fire, epidemic, war, terrorism, civil unrest, government action, change in law, regulatory direction, labour dispute, power, internet or telecommunications failure, cyberattack or denial-of-service attack, and any failure, outage, restriction or decision of TradingView, Cloudflare, our hosting provider, a data vendor, an exchange (including a trading halt or data outage) or a payment provider (each a "Force Majeure Event").

20.2 Our obligations are suspended for as long as the Force Majeure Event continues. We will use reasonable efforts to reduce its effect and to inform you where practicable.

20.3 If a Force Majeure Event prevents us from providing access to WickTap for more than thirty (30) consecutive days, either you or we may end the affected Subscription by notice, and Section 16.4 applies.

21. Privacy

21.1 We process personal data in accordance with the PDPA and our Privacy Notice, which is available on the Website in Bahasa Melayu and English.

22. Notices

22.1 Notices to you. We may give you notice by email to the address you provided to us, or by a notice on the Website. An email notice is treated as received when it is sent, unless we receive a message that it was not delivered. A Website notice is treated as received when it is published. You must keep your email address up to date.

22.2 Notices to us. You must send notices to us by email to hi@wicktap.com. A notice is treated as received when it reaches our mail server, if that is before 5:00 p.m. on a business day in Kuala Lumpur, and otherwise on the next business day.

22.3 Notices and communications given by email satisfy any requirement that they be in writing, to the extent permitted by the Electronic Commerce Act 2006.

23. General

23.1 Entire agreement. These Terms, together with the documents listed in Section 1.5, are the entire agreement between you and us about their subject matter, and replace any earlier understanding. You acknowledge that, in entering into these Terms, you have not relied on any statement, representation or promise (including in advertisements, social media, chats, Replays or Illustrative Reviews) that is not set out in these Terms. Nothing in this clause limits liability for fraud or any liability under Mandatory Law.

23.2 Severability. If any provision of these Terms is found to be invalid, illegal, unenforceable or unfair (including under Part IIIA of the CPA), it shall, to the extent permitted by law, be treated as modified to the minimum extent needed to make it enforceable or, if that is not possible, removed. The rest of these Terms continue in full force.

23.3 No waiver. A failure or delay by us in exercising any right is not a waiver of it, and a single or partial exercise of a right does not prevent its further exercise.

23.4 Assignment. We may assign, novate, transfer or subcontract any of our rights or obligations under these Terms to any person, including a successor to or buyer of our business, and you consent in advance to any such novation. This does not reduce any right you have under Mandatory Law. You may not assign or transfer any of your rights or obligations without our prior written consent.

23.5 Relationship. Nothing in these Terms creates a partnership, joint venture, agency, employment, fiduciary or advisory relationship between you and us.

23.6 Third parties. Except for the Indemnified Persons under Section 15, no person other than you and us has any right to enforce these Terms.

23.7 Remedies. Our rights and remedies under these Terms are cumulative and in addition to those provided by law.

23.8 Language. These Terms are written in English. Before we accept any Direct Purchase, we will make the sale terms and the information in Section 25 available in Bahasa Melayu, as required by regulation 4 of the Consumer Protection (Electronic Trade Transaction) Regulations 2024. If a translation conflicts with the English version, the English version prevails to the extent permitted by law.

24. Governing law and disputes

24.1 These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes), are governed by the laws of Malaysia.

24.2 Before starting proceedings, you agree to contact us at hi@wicktap.com, describe the dispute, and allow us thirty (30) days to try to resolve it in good faith. This does not prevent either party from seeking urgent interim relief, and it does not affect any limitation period.

24.3 Subject to Sections 24.4 and 24.5, the courts of Malaysia sitting in Kuala Lumpur have exclusive jurisdiction, and you submit to that jurisdiction and waive any objection to it on the ground of venue or inconvenient forum.

24.4 If you are a Consumer, nothing in this Section prevents you from lodging a claim with the Tribunal for Consumer Claims Malaysia within its jurisdiction, or deprives you of any protection under the mandatory law of the place where you live that cannot be excluded by agreement.

24.5 We may seek injunctive or other equitable relief to protect our intellectual property or confidential information in any court of competent jurisdiction.

25. Online seller disclosures (Consumer Protection (Electronic Trade Transaction) Regulations 2024)

25.1 The Consumer Protection (Electronic Trade Transaction) Regulations 2024 (P.U.(A) 449/2024), in force from 25 December 2024, revoked and replaced the Consumer Protection (Electronic Trade Transactions) Regulations 2012.
